Not Medical Advice

Guidance vs Medical Advice

There is a legally significant difference between the two. Kiri provides guidance — informational content to support caregiver awareness — not the professional medical advice rendered by a licensed provider in a clinical relationship. See Section 3.

Consult Your Pediatrician

Always consult your child’s pediatrician or qualified healthcare provider for any medical concern, symptom, diagnosis, treatment, or health decision. See Section 4.

Emergencies

Kiri is not an emergency service. If your child may be experiencing a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on Kiri in lieu of emergency care. See Section 5.

AI-Generated Outputs

Kiri uses AI to generate personalized guidance. AI outputs are informational only and subject to the limitations in this disclaimer and our AI Use Policy. See Section 6.

No Clinical Relationship

Using Kiri does not create a physician-patient or any other professional healthcare relationship between you and Kiri or Presence Health, Inc. See Section 7.

Limitations and Liability

Kiri expressly disclaims all liability for reliance on its outputs in connection with any healthcare decision. See Section 8.

Your Responsibilities

You are responsible for evaluating Kiri’s guidance, making independent health decisions, and seeking appropriate professional care. See Section 9.

This Medical Disclaimer (“Disclaimer”) is published by Presence Health, Inc., d/b/a Kiri (“Kiri,” “we,” “us,” or “our”) and applies to all users of the Kiri mobile application, the Kiri website at www.saykiri.com, and any related features or services (collectively, the “Services”). It explains the nature and limitations of the information, guidance, and outputs that Kiri provides, including those generated by its artificial intelligence features.

This Disclaimer should be read in conjunction with Kiri’s Privacy Policy and Artificial Intelligence Use Policy, both of which are incorporated herein by reference. Where a matter is addressed in both this Disclaimer and another Kiri policy, the more specific policy governs with respect to that subject matter. See Section 10 for a cross-reference to related policies.

Kiri can help you track your child’s health, understand patterns, and feel more prepared for conversations with your pediatrician. But it is not a substitute for those conversations. No matter how detailed Kiri’s guidance seems, it is providing information — not professional medical advice. Your child’s doctor is always the right source for real medical decisions.

2.1 Scope of Kiri's Guidance

Kiri is designed to support parents and caregivers with information, educational content, tracking tools, and personalized guidance related to infant and child health, development, and daily care routines. Kiri is an informational resource, not a medical service.

The Services, including all content, summaries, insights, responses, and AI-generated outputs provided through the Services, do not constitute:

  • Medical advice, clinical diagnosis, prognosis, or treatment recommendations of any kind;

  • Clinical assessment or evaluation of any individual’s health condition;

  • Prescriptions or recommendations for any medication, supplement, dosage, or therapeutic intervention;

  • A second opinion on any diagnosis or treatment plan rendered by a licensed healthcare provider; or

  • A substitute for the professional medical judgment, care, or treatment provided by a licensed physician, pediatrician, nurse practitioner, or other qualified healthcare professional.

Nothing in the Services — including content generated by Kiri’s AI Pediatric Specialists or any other automated feature — should be construed as constituting any of the above, regardless of how a question is framed or how specific a response may appear.

2.2 Not a Medical Device

Kiri is not a medical device and has not been cleared or approved by the U.S. Food and Drug Administration (FDA) for any diagnostic, clinical decision support, or therapeutic purpose. Kiri is not a clinical decision support system as that term is defined under applicable federal law or FDA guidance. Nothing in the Services is intended to meet the definition of a medical device under 21 U.S.C. § 321(h) or any analogous provision of applicable state law.

  1. Guidance vs. Medical Advice, Legal Distinction

When a doctor gives you medical advice, they’re doing so under a professional license and are legally responsible for it. Kiri provides information — helpful, personalized information based on your data — but it is not the same thing as a professional consultation. Think of Kiri as a well-informed resource, not a clinician.

The distinction between “guidance” and “medical advice” carries legal significance that users of the Services should understand.

“Medical advice,” as that term is used under applicable law, generally refers to the provision of a professional opinion or recommendation by a licensed healthcare practitioner, rendered in the context of a clinical relationship, based on an individualized assessment of a specific patient’s condition. The provision of medical advice is a regulated activity subject to state licensing requirements and professional liability standards.

All content and outputs provided through the Services constitute “guidance” — that is, informational and educational content intended to support caregiver awareness and decision-making. Such content:

  • Is not an individualized professional recommendation based on clinical evaluation;

  • Is not rendered by a licensed healthcare provider in the course of a clinical relationship;

  • Does not substitute for consultation with a licensed physician, pediatrician, nurse practitioner, or other qualified healthcare professional;

  • Does not create any professional duty of care owed by Kiri to the user or the user’s child; and

  • Should not be interpreted as implying any clinical authorization, certification, or endorsement of any course of action.

In accordance with California Assembly Bill 489 (effective January 1, 2026), Kiri expressly acknowledges that neither the Kiri platform nor its developers are licensed or certified to diagnose, treat, cure, or practice with respect to any physical or mental health condition. No output of the Services should be construed as implying such licensure or certification.

  1. Always Consult Your Pediatrician

Kiri is not your pediatrician, and it is not trying to be. If something concerns you about your child’s health, please call your doctor. Kiri can help you organize your thoughts and observations, but it cannot examine your child or take responsibility for their care.

Kiri is designed to complement, not replace, the guidance of your child’s pediatrician or qualified healthcare provider. You should always consult a licensed medical professional for:

  • Any medical concern, symptom, or change in your child’s health or behavior;

  • Decisions about diagnosis, treatment, or medication;

  • Ongoing management of any medical condition, developmental concern, or chronic illness;

  • Questions about immunizations, nutrition, or growth; and

  • Any other matter that may affect your child’s physical or mental health and well-being.

Do not delay seeking, disregard, or discontinue professional medical advice or treatment based on information provided by Kiri. If Kiri’s guidance conflicts with the advice of your child’s healthcare provider, the advice of your healthcare provider should always prevail.

  1. Emergency Situations

Kiri is not an emergency service and is not equipped to respond to medical emergencies. If you believe your child may be experiencing a medical emergency, you must take immediate action:

  • Call 911 (or your local emergency number) immediately, or

  • Proceed to the nearest emergency room or urgent care facility without delay.

Do not use Kiri to seek guidance in an emergency. Do not wait for an AI-generated response before seeking emergency care. Time-sensitive situations require immediate professional intervention, and no output from Kiri is a substitute for emergency medical services.

  1. AI-Generated Guidance

Kiri reads the data you’ve entered — like how long your baby slept or how much they ate — and uses AI to help you see patterns and get answers to your questions. It’s designed to help you feel more informed, not to replace the advice your pediatrician gives you. AI can make mistakes, and it doesn’t know your child the way their doctor does.

6.1 Nature of AI Outputs

Kiri uses artificial intelligence, machine learning, and natural language processing to generate personalized guidance based on the information you provide about your child. While we are committed to providing helpful and relevant content, all AI-generated outputs are informational only.

You should understand that AI-generated outputs:

  • May be incomplete, inaccurate, or outdated, and may not reflect the most current clinical guidelines or research;

  • Are based solely on data you have entered into the Services and cannot account for information not provided, including your child’s full medical history;

  • Cannot account for all individual health factors, circumstances, or conditions;

  • Are probabilistic in nature and may not be accurate for your child’s specific situation;

  • May reflect biases present in underlying training data and may not be equally applicable to all individuals or populations; and

  • Should be interpreted as supportive context, not as definitive clinical conclusions.

You are responsible for critically evaluating how you apply any AI-generated guidance to your child’s care, and for consulting a qualified healthcare provider before making health decisions.

6.2 Relationship to AI Use Policy

The scope, limitations, and legal distinctions applicable to Kiri’s AI features are addressed in greater detail in Kiri’s Artificial Intelligence Use Policy, which is incorporated into this Disclaimer by reference and available within the App and at www.saykiri.com. The AI Use Policy includes additional disclosures regarding automated processing limitations, bias and error, the guidance-versus-medical-advice distinction, and the express disclaimer of liability for AI-generated content.

  1. No Provider-Patient Relationship

Because no clinical relationship exists, Kiri’s outputs do not carry the same weight as advice from a licensed professional who has examined your child and taken responsibility for their care. This is one of the key reasons why consulting your pediatrician for real medical concerns remains essential.

Use of the Services, including use of any AI features or submission of any question or information through the Services, does not establish a physician-patient relationship, a nurse-patient relationship, a therapist-client relationship, or any other professional healthcare provider-patient or provider-client relationship between you and:

  • Kiri or Presence Health, Inc.;

  • Any employee, contractor, or agent of Kiri or Presence Health, Inc.; or

  • Any third-party provider engaged by Kiri in connection with the Services.

No individual or entity at Kiri is acting as your child’s healthcare provider. Kiri does not owe, and you should not expect, any professional duty of care as a result of your use of the Services.

  1. Material Limitations and Disclaimer of Liability

IMPORTANT

All content and outputs provided through the Services — including AI-generated outputs, summaries, insights, trend analyses, and informational content of any kind — are provided for tracking and informational purposes only.


Nothing in the Services constitutes, or is intended to constitute, medical advice, clinical diagnosis, prognosis, or treatment recommendations.


Do not make healthcare decisions based solely on information generated by the Services. Always consult a qualified, licensed healthcare professional regarding any concern about your child’s health, development, or well-being.


For medical emergencies, call 911 or your local emergency services immediately.

8.1 Accuracy and Completeness

Kiri makes reasonable efforts to provide helpful and accurate content, but does not warrant that any content, guidance, or AI-generated output is accurate, complete, current, or applicable to your child’s specific circumstances. The Services operate on data you have provided; they cannot examine your child, access your child’s full medical records, or account for information not entered into the Services.

8.2 Disclaimer of Liability

KIRI AND PRESENCE HEALTH, INC. EXPRESSLY DISCLAIM ALL LIABILITY ARISING FROM ANY RELIANCE ON THE SERVICES — INCLUDING ANY AI-GENERATED OR AUTOMATED OUTPUT — IN CONNECTION WITH ANY HEALTHCARE DECISION, TREATMENT CHOICE, DIAGNOSIS, OR COURSE OF ACTION. THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR COMPLETENESS. NEITHER KIRI NOR PRESENCE HEALTH, INC. SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR RELIANCE ON ANY CONTENT OR OUTPUT PROVIDED THROUGH THE SERVICES.

By using the Services, you acknowledge and agree that you are solely responsible for:

  • Providing accurate and complete information when using the Services;

  • Independently evaluating all content and guidance provided through the Services before acting on it;

  • Consulting a licensed pediatrician or qualified healthcare provider for any medical concern or health decision relating to your child;

  • Seeking immediate emergency medical care when warranted, without relying on the Services in lieu of doing so; and

  • All decisions made — whether to act or not act — based on information provided through the Services.

Kiri is a tool to support you as a caregiver. Its value depends on how you use it alongside — not instead of — the professional medical relationships you maintain for your child.

IN-APP CONSENT NOTICE

The following notice appears within the Kiri app and is acknowledged by users prior to accessing the Services:


“Kiri provides guidance, not medical advice. It does not replace your pediatrician for diagnosis or treatment. For medical concerns, consult your pediatrician. For emergencies, seek immediate care. By continuing, you agree to this use of your data and understand the scope of Kiri’s guidance.”

By accessing or using the Services, you acknowledge and agree that:

  • You have read and understood this Medical Disclaimer in its entirety;

  • You understand that all content and outputs provided through the Services are informational only and do not constitute medical advice, diagnosis, or treatment recommendations;

  • You will not use the Services as a substitute for consultation with a licensed healthcare professional;

  • You understand that no clinical or professional healthcare relationship is created by your use of the Services;

  • You will seek immediate emergency medical care and contact emergency services if you believe your child is experiencing a medical emergency, without relying on the Services in lieu of doing so; and

  • Your continued use of the Services constitutes ongoing acceptance of this Disclaimer, as amended from time to time in accordance with Section 12.

We may update this Disclaimer at any time. If we make material changes, we will update the Effective Date above and provide notice to registered users through the App or by email. Your continued use of the Services following the posting of any amendment constitutes acceptance of the revised Disclaimer.

Where a change to this Disclaimer materially affects users’ rights or requires renewed acknowledgment under applicable law, we will seek such acknowledgment before permitting continued access to the relevant features.
